What Is the 50% FEMA Rule?

If you own property in a designated flood zone, any improvements or repairs you make may be subject to the FEMA 50% Rule, also known as the Substantial Improvement Rule. This regulation requires that if the cost of improvements or repairs to a structure exceeds 50% of its depreciated market value (the Actual Cash Value, or ACV), the entire structure must be brought up to current floodplain management standards, including Base Flood Elevation (BFE) requirements.

Land value is not included in this calculation. Local building departments require a certified 50% FEMA Rule appraisal before they can approve permits for projects that fall within this threshold.

From the FEMA Desk Reference:

"If the cost of improvement and addition or the cost to repair exceeds 50% of the depreciated market value of the structure, it must be brought up to current floodplain management standards."

All properties, residential or commercial, located in flood zones A1-30, AE, AH, V1-30, V, and VE on the Flood Insurance Rate Map (FIRM) that have not been elevated to Base Flood Elevation are subject to this rule. Properties located in V zones must be constructed on erected piles.
